Workers' Compensation Benefits and Coverage

If you are injured in a work-related accident, you may have a right to receive workers' compensation benefits. If your employer has at least four employees (part or full time), they are required by South Carolina law to maintain workers' compensation insurance for the benefit of their employees.

The amount of benefits you receive depends on a number of factors, including:

  • The nature of your injury (partial or permanent)
  • The body part that was injured
  • Your wages prior to the injury

As a general rule, there are three basic types of benefits you may receive. The first type of benefit is medical expense coverage. This includes the cost of your necessary medical treatment. However, the workers' comp insurance adjuster may try to limit the amount and type of medical care you receive.

The second type of benefit is lost wages. As a general rule, workers' compensation only pays a percentage of your normal wages. The total amount of lost wages you may receive depends on your wages prior to the injury, and the duration of your injury. In many cases, the workers' compensation insurance adjuster will try and limit an employee's lost wages by alleging that the employer is capable of returning to work before they are able.

The third type of workers' compensation benefit that may be available to an injured worker is a final settlement. A final settlement may be obtained in cases where an employee has sustained a permanent  impairment or disability, or can no longer earn the same wages.
